SleepNest provides smart mattresses, mobile applications, and related services designed to optimize your sleep quality. Our services include temperature regulation, adaptive comfort adjustment, sleep tracking, and personalized sleep insights.

3. Trial Period and Returns

We offer a 100-night trial period for our mattresses. If you are not satisfied, you may return the mattress for a full refund within this period. The mattress must be used in accordance with care instructions. Details of the return process are available on our website.

4. User Accounts

To access certain features, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete registration information
• Notifying us immediately of any unauthorized use

5. Health Disclaimer

SleepNest products and services are designed for general wellness purposes. Sleep data and insights are NOT intended to diagnose, treat, cure, or prevent any medical condition or sleep disorder. Always consult a healthcare professional for medical advice or if you have sleep-related health concerns.

You agree not to:

• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our services
• Reverse engineer or modify our products or software

7. Intellectual Property

All content, features, firmware, and functionality of our products and services are owned by SleepNest and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

8. Subscription Services

Some premium features may require a subscription. Subscription terms, including pricing and renewal terms, will be clearly disclosed at the time of purchase. Basic sleep tracking is included with your product at no additional cost.

9. Third-Party Services

Our products may integrate with third-party applications and services (such as health apps and smart home systems). We are not responsible for the content, privacy practices, or terms of these third-party services.

10. Warranty

SleepNest mattresses come with a 10-year limited warranty covering manufacturing defects and technology components. This warranty does not cover normal wear, staining, physical damage, or damage from misuse. Full warranty terms are provided with your product.

11. Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, EXCEPT AS EXPLICITLY STATED IN YOUR PRODUCT WARRANTY. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SLEEPNEST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR PRODUCTS OR SERVICES.

13. Indemnification

You agree to indemnify and hold harmless SleepNest and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our products or services or violation of these Terms.

14. Termination

We may terminate or suspend your access to app features at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests. Your mattress will continue to function in basic mode.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through mediation. If mediation fails, disputes shall be resolved through the courts of Melbourne, Victoria, Australia.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting a notice on our website or through the app. Your continued use of our services constitutes acceptance of the modified Terms.
